Legal use of photo in small business website?

I'm trying to set up a website for my consulting firm and I'd like to use a
photo from MS's clipart. Can I do so without violating anyone's copyright? I
won't be selling the photo or making any money on the photo, but I'm hoping
the website will help me to develop some business. Thanks for your thoughts.

http://office.microsoft.com/en-us/tou.aspx
See the EULA

If you have a valid license to Office, you can use the clips:

Personal items
Business items, under the following restrictions:

1. The clip should not be used as a part of your logo.
2. If you are selling an item which depicts the clip, the clip cannot be
the primary value of the item ( you cannot sell a clipart collection or sell
a book of just clipart, etc)

Re: Legal use of photo in small business website?

Thank you very much for your reply. Yes I do have a valid license for MS
Office. I think I am safe based on what you said, but I want to just check
one more thing with you. I won't be using the photo for the logo, but what I
would like to do is to crop the photo and use part of it the masthead area of
the home page next to my company name. I don't think that would be
considered a logo, but I just want to be sure.
As it stands, it seems I can use the photo in good conscience, but I do want
to be in compliance with any copyright restrictions.
Thanks again for your reply.
